Hi there! Welcome to Walktide.
These Terms of Service ("Terms") constitute an agreement between you ("you" or "user") and Brisk Longevity, LLC ("Company," "we," or "us"). These Terms govern your access to and use of the Walktide mobile application ("App") and any related services (collectively, the "Services").
Please read these Terms carefully before using the Services. By downloading, installing, or using Walktide, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the app.
Will These Terms Ever Change?
We may update these Terms from time to time. When we do, we will revise the Last Updated date above. Your continued use of the Services after changes take effect constitutes your agreement to the updated Terms.
What Is Important to Remember When Using Walktide?
Walktide does not provide medical advice, diagnosis, or treatment. Step count data is provided for informational purposes only and should not be used as the basis for medical decisions. Always consult a qualified healthcare provider before making changes to your diet, exercise, or lifestyle. If you are experiencing a medical emergency, call 911 immediately.
Using the App
You may use Walktide for personal, non-commercial purposes only. You agree not to misuse the app, attempt to access it through unauthorized means, reverse engineer or decompile it, or use it in any way that violates applicable laws. You must be at least 18 years of age to use the Services.
Subscription and Billing
Walktide is available through a subscription with a 7-day free trial. After the trial period, the subscription automatically renews at $9.99 per year unless cancelled. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your iPhone Settings under Subscriptions. No refunds are provided for unused portions of a subscription period. Prices are subject to change with advance notice.
Apple App Store Additional Terms
Walktide is distributed through the Apple App Store. These Terms are between you and Brisk Longevity, LLC only, not with Apple Inc. Apple has no obligation to provide maintenance or support for Walktide. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. Apple is not responsible for any claims relating to Walktide. Apple and its subsidiaries are third party beneficiaries of these Terms with respect to Walktide, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third party beneficiary.
Intellectual Property
Walktide and all content, features, and functionality of the Services are owned by Brisk Longevity, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.
No Warranty
The Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the app will be error-free, uninterrupted, or meet your specific requirements.
Limitation of Liability
To the fullest extent permitted by applicable law, Brisk Longevity, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Walktide. Our total liability shall not exceed the greater of $100 or the amount you paid to us in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold Brisk Longevity, LLC and its officers, agents, and employees harmless from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Travis County, Texas.
Changes to the Services
We may modify, suspend, or discontinue any part of the Services at any time. We will try to provide notice of material changes but cannot guarantee it.
Termination
We may suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms.
