This usage complies with Apple's HealthKit guidelines and Google's Health Connect permissions policy.For Android users: Walktide only requests the Health Connect permissions necessary to display your step count and walking activity. We do not access any Health Connect data beyond what is required to provide the core functionality of the app. The specific data types we access are: steps, active minutes, and walking distance.IV. The app connects to Apple Health (iOS) or Google Health Connect (Android) to read your step data. You are responsible for maintaining the security of your device and any data associated with your use of the Services.What Are My Rights in the Services?The Walktide app and all content, features, and functionality of the Services are owned by Brisk Longevity, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Services without our prior written consent.Subscription and BillingWalktide is available through an auto-renewable subscription with a 7-day free trial. After the trial period, the subscription automatically renews at $9.99 per year unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.You can manage and cancel your subscription at any time through your device settings. No refunds are provided for unused portions of a subscription period. We reserve the right to change subscription pricing with advance notice. Your continued use of the Services after a price change constitutes your agreement to pay the changed amount.Apple App Store Additional TermsWalktide is distributed through the Apple App Store. These Terms are between you and Brisk Longevity, LLC only, and not with Apple Inc. Apple has no obligation to provide maintenance or support for Walktide. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any.Apple is not responsible for any claims relating to Walktide, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection legislation. Apple and its subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third party beneficiary.You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.Will Company Ever Change the Services?We are always trying to improve the Services, so they may change over time. You may cancel your subscription at any time through your device settings. Brisk Longevity, LLC is also free to terminate or suspend your access to the Services for any reason, including your breach of these Terms.Choice of LawThese Terms are governed by and construed under the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the courts of Travis County, Texas.Arbitration and Class Action WaiverIn order to expedite and control the cost of disputes, you and Brisk Longevity, LLC agree that any legal or equitable claim arising from or related to your use of the Services or these Terms will be resolved by binding arbitration under the JAMS Comprehensive Arbitration Rules and Procedures. The place of arbitration shall be Austin, Texas. You are giving up the right to litigate disputes in court before a judge or jury.Any proceedings to resolve disputes will be conducted solely on an individual basis. You may not seek to have any dispute heard as a class action.
